The Individual Education Plan
The Individual Education Plan (IEP) is a written document developed by teachers, principals, parents, and other relevant school staff for a child that is eligible for special education. The child must meet the eligibility requirements for special education: the child has a disability and the child requires special education and the services related to the disability in order to receive general education.

Special Education Eligibility
According to the Virginia Department of Education website, schools must evaluate and identify children who may need special education. Screenings are conducted by the schools. If the results of a screening suggest a disability then the parents are notified along with special education professionals within the school.

Functional Behavioral Assessment
A functional behavioral assessment (FBA) may include either a existing data or new data or evaluation as delinated by the IEP. According to guidelines, school districts are required to conduct FBAs for students who have been subject to disciplinary actions where the behavior was determined to be because of the student's disability.

Request for Due Process
Although many disputes between parents and schools may be resolved through dialogue, IDEA provides legal means by which parents may challenge aspects of their child's special education regimen. "Due process" begins with a formal complaint from the parents. An official resolution session is called for the parents and school officials. If no resolution occurs, then a due process hearing is called. The hearing officer makes a decision regarding the presented evidence and testimony. The officer's decision can be challenged by either the parents or the schools.
